    OMy question involves criminal law for the state of: oh
    Approximately 4years ago I was at a local discount store shopping with my wife. I found two sprinkler cans for two different prices but the same product. They had tags underneath and I tried to see what the prices were. Anyways we continued supping and then went to check out. My wife left the store. At checkout I asked the cashier. What the price was. She said someting like 4.99 I said well the other is marked differently. Since she.or I weren't sure I asked if I could take it up to customer service. Which is on-the-job way out. I paid for my items. Started towards customer service and was stopped by a.Guy who said.."your going to walk out with those aren't you?".I said no I was going to customer service. He again said I was going to steal them and that he saw.me changing tags which I didn't do.
    He asked me to come with him. I asked him who he was he said security but wouldn't identify his name or show a badge etc. He checked my receipt saw that the girl charged me for pencils.but didn't charge me to the.lousy basket the pencils were in. He Sid we need to go upstairs. I did.. After 20 to 30 min he finally game me his name and showed me somelind of badge. I kept telling him that I wasn't stealing anything. He was a ass.He asked me how.much money I had on me I told him around 62.00. He.said I had to give him all I had. I gave him the money and he made me sign something stating I would not go back to the store. I was.a.nervious wreck. I suffer from PTSD and be had me in this little room taking photos taping our conversation and much more.I wasn't thinking clearly and I sure didn't try to rip.them off. Anyways the police weren't called. He took all my money plus the 50 or 60 dollars.worth of groceries. I wasn't given anything that I purchased. I was left with 25 cents. This took about 1.5 hours.

    About a year goes by and my wife and I r at a pet store in the same plazza. A Guy comes around the corner and says something like How r you doing I didn't recognize him and I put my hand out to shake his and he said you don't remember me do u. I said sorry irony. He says well u shouldn't forget me because I'm the Guy that caught u at the store.. I couldn't believe that he followed us into.that store a store he has nothing to do with. Again about another year goes by and I see him outside the store he works for. I pull up and say how r you doing not thratning or anything just trying to work things out with him. He gets pissed and says I can't be in the parking lot waiting for my wife even though there r several other stores. He tells me he is going to cuff me and have me arrested. I told him that he couldn't do a thing and parked my car and waited for my wife...nothing happened. He is a pain. I called the corporate office to complain and talked to the loss prevention supervisor said he would talk to him and call me back..he never did.

    Can they take alluring money from u plus what you paid for and also how can someone think your going to walk out the door with items. I've never shoplifted and have never been in trouble and frankly this Guy needs to loose his job

    Well, with just your side of the story to go on, yes, this guy does seem like a bit of an ass. And, no, what you described does not sound like proper loss prevention procedure. However, although it sounds like he was somewhat overzealous and jumped the gun, I can see how his suspicions were aroused. Peeling off price tags and then walking past the cashier with those items is something that would attract an LP's attention.

    The problem is, the time to address his behavior was 4 years ago. After this much time, you are not likely to have much credibility with his supervisor or the store management. That "something" you signed was almost assuredly an admission that you were shoplifting...You signed a confession! So, your claims now about his behavior 4 years ago aren't going to carry much weight.

    Four years ago is the original 'occurrence'? Then a year goes by and you have another encounter with the same guy, but at a different store? Then, another year goes by and you pull up to be all cordial outside of the store you were busted at?

    So! The latest occurrence is approximately two years ago? Might I inquire as to why you waited two years to look into all this?

    And if ya got a minute, would you be so kind as to explain what "alluring money" is? :wallbang:

    I would say this:

    If the guy found you in Store B a year later....he should have simply kept a discreet eye on you, notified the store security of a potential shoplifter, and never approached you. BUT - do you know for a fact if he works at the second store or not? Some people have second jobs...though he still should have been discreet and just watching.

    If you had paid for your groceries at the time, why did you not demand to take them then, or complain immediately? I'd have also asked for a receipt for the cash you had in hand at the time.

    As to what the trespass order states....I can't see it, so I can't read it.....but you would be best to let your wife drive herself. Because the parking lot can be included.

    I would not even say hello to the LP guy in a nightclub.....let alone drive up to him in the parking lot of the store you were accused at..... (and if the two guys that busted me approached me in a social setting, being female, I would be making one hell of a scene)

    None of this makes sense......
