Misdemeanor Probation Violation
My question involves criminal law for the state of: Georgia. Last November I got charged with no insurance and concealed weapon ( brass knuckles) and was put on early retearmation probation in which i would be taken off when my fine was paid for. I recently got arrested for obstrution of justice, no insurance, and underage possesage of achohol. In which I have court on the 13th of this month. I am still on probation from the charges before with a 500 dollar remaing balance and was wondering if i get charged with this if I will go to jail for a probation violation????!!!

I have never heard of someone being on probation where the terms did not state that a new arrest would not be a violation. I think returning to jail is a very real possibility but that decision will be up to the judge.

But i only stayed an hour in jail both times and this is the only thing i have on my record..

A misdemeanor charge while on misdemeanor probation should constitute a violation. It does not matter if you only stayed 15 minutes in jail. It is still classified as an arrest. Yes, you can possibly go to jail for some days.
Violation of Probation (Juvenile in Texas)

I am currently on probation for a possession of marijuana charge in the state of Texas. I accepted a deferred agreement that was offered to me and am currently serving 3 months of juvenile probation, along with seeing an individual counsler weekly. This past week, I was letting a friend drive my truck because we were looking for his girlfriend who was making suicidal remarks. I had taken a couple drinks of an alcoholic beverage at the house we were at, hence the reason as to why he was driving my truck. We were stopped for speeding (keep in mind this was somewhat an emergency), and he was asked by the officer to step out of the vehicle and around to the back. To my knowledge, he hadn't been drinking, which is why he was driving my truck. However, the officer returned to tell me that said driver admitted to drinking a beer. (He's 19) There was open containers in the vehicle and I told the officer exactly what I'm telling you all now - that I was completely unaware of his consumption of alcohol. The officer gave the driver a ticket for speeding and an open container. I informed the officer that I was currently on probation and he decided to not give me a ticket, but rather, to contact my probation officer. This took place after my curfew stated in the deferred agreement (6 P.M), so now I have violated my probation. I was just wondering if any of you have any knowledge as to the consequences I could suffer because of this. No rude replies, please. I'm just trying to be prepared for my meeting with my probation officer this coming up week. Any help would be awesome! Thanks, guys!
