    Not Considered for Promotion Because of Relatives
    My question involves labor and employment law for the state of: Florida

    The company I work for won't consider me for a promotion from part-time to full-time because I have a relative that is already full-time within the company.
    Am I being discriminated against?

    Is this a real big company?? They gave you a reason, and I won't start yelling discrimination, as it'll most likely backfire on you, and might get you fired.

    I've been in management all my life, and currently at one at a small non-profit. In all the years, people with deficiencies wanting promotions, not getting them, often do not get the REAL reason they are not promoted, such as "you are not qualified". This may mean you may not have the qualifications or personality for the job, but the boss is either "too scared" to tell you, or try not to "hurt your feelings". But it is true in many small companies, they don't want relatives being managers of related departments either.

    As far as being discriminated against, this happened to me some years back, and I worked at a Fortune 500 company. I started as an analyst, then a senior analyst, then a senior analyst with some management responsibilities, In the 3 short years I was there, analysts that came in after me got promoted to managers, not ONE having an MBA that I did, and at the time, coworkers in the place considered me overqualified. One day I was shooting the breeze with my manager, and very friendly chap, and in his case, did not get the promotions he deserved either, and many in the company felt he was overqualified, so in a sense, he's in the same boat as me.

    He mentioned to me for promotions, "ability is one of the many aspects being considered", and that was told him when he asked about it. He said that is also true in my case. So I added that I felt as a small statured Asian, I'm discriminated against, and the ones being promoted are all over 6 foot tall white guys, macho looking, one played football, and I asked him if my height and his weight, he's over 300 pounds and balding, and no way looked a manager, has anything to do with it.

    He readily admitted it is true, but no one in management ever mentioned these REAL reasons to us, and often the reason given for the promotions to "those guys" we'd be told that they have special qualifications. I thought it was very funny that my management responsibilites include doing special projects, translation being doing stuff other "these macho looking guys" can't do, and I am not considered qualified.

    However, persistence has it's rewards. I gone interviewing, and worked with a job recruiter that kept hearing stories of this overqualified guy, me, and finally got a management position at another company with a big raise. And it was at that point that my company counter-offered, the Treasurer created a manager job for me, with a big raise, about 50%. By then I told them it was too late because with the new job, I'd be moving back closer to my family, I would be able to expand my horizons a bit. I told them had they offered me the job a year earlier, I would've been thrilled. They looked stunned, and repeated "but it's a 50% raise, did you hear it right??". LOL LOL.

    Now, what warmed my heart was some years later, I heard there were arguments in the company why they lost me and who was to blame. Looking back, I didn't get a lawyer to yell discrimination, didn't burnt all my bridges, and they finally realized themselves what they did wrong, and convinced myself I did the right thing. And I still used them as a reference, and better for them to say "we're so sorry we lost this valuable guy", as compared to "that stupid prick sued us". I actually heard they told people they were sorry.

    And just to add that the only black women in the building was fired after she made big noises that she has friends in the NAACP, and they're in big trouble for not promoting her.

    If I were you, start looking around, and I'm sure there are spots out there that would suit you, and if you are THAT GOOD, then they'll counteroffer. If not, it's their loss, not yours.

    Yes. But you are not being ILLEGALLY discriminated against.

    Contrary to what far, far too many people believe, not all or even most discrimination is illegal. It is only illegal when based on a characteristic protected by law. Having a relative working there full time is not a characteristic protected by law.
