Somebody Wrote a Book Based on My Life
My question involves court procedures for the state of: not sure which state has jurisdiction
I recently found a book that was published. It is stated a biography true life events of a woman brought here from another country as a wife looking for a great life with her new husband. She lives in NH. Our family is scattered now.. some in Ma, SC, and Ohio. Some are deceased. The events in this book happenned in Fl and Ma.
She changed some names around but did use some real names of a whole family. Her husband was my father. She uses all his sisters in the book, his mother, his children, herself, her children and she twists everything into a story of horror which is totally untrue. My father and grandmother are deceased. I certainly did not like reading a book of such hatred and abuse she stated a life events. She said i would punch and kick her plus bite her. Untrue. An aunt would defactate in the bathtub and make her clean it. She was starved, only fed peanut butter for a year. She made herself some pitiful servant and told the stories what the children, mother in law and sis in laws would do to her as abuse. She says her sis in laws did nothing but steal from her and decieve her plus abuse her. She was their servant and not allowed to eat or dine with the family.
Some things are true but the abuse is in her mind. She uses real life times, places and events. This woman is whacked and tarnishes our memories of our family. What can I do?
She also plans to publish 2 more books.
She does not state that the characters are fictional
Re: Somebody Wrote a Book Based on My Life
Are you sure it's published as a memoir or autobiography and not as fiction? Did she use your real name and is there slanderous things in the book about you specifically?
Re: Somebody Wrote a Book Based on My Life
I am positive it is published as a biography and memoirs. She changed a few names around and didnt use my real name but her husband had 3 children with only one a daughter. She described us, our house, our location, our family. She used her real name as author and didnt write a fiction disclaimer. She wrote many slanderous things about me, my father, my grandmother and my aunts. My father and my grandmother are deceased. She wrote she had hope and promise when she came here only to be led into a life of servitude and poverty which is so not true. She describes horrible things that never happenned. Said her husbands daughter ( me) was a evil child who kicked, punched and bit her and also she came out of the bathroom to find me choking my baby brother. I always lied on her to my grandmother and said she was trying to kill us. She said it was a house of horror. My aunts defecated in bathtub to which this woman was made to clean. She was fed only peanut butter for a year while she cooked and cleaned like a slave. She wasnt allowed at the dining room table with the family. She said she brought many pieces of jewelry here and we sole them. My aunt would make her babysit her 3 children while she drank and had so many men coming and going it looked like a bus station at her house. Many more horrible terrible things which are so untrue. She was married to my dad straight out of another country 40 years ago and divorced 30 years ago. She really must hate everyone to do this
There are many facts in this book and many many untrue statements and many chapters she twists around to make everyone look bad. She stated she snuck and got her drivers liscense and when she showed my father he gave her a black eye.
She has been doing book signings on her life biography and plans to write 2 more sequels.
Re: Somebody Wrote a Book Based on My Life
What damages have you suffered as a result of this book?
Re: Somebody Wrote a Book Based on My Life
How many people have read the book? How would people figure out that a character is based on you?
You can consult a defamation lawyer about the book, taking a copy with you to your case evaluation with key allegedly defamatory passages bookmarked. You can discuss with your lawyer how much it is likely to cost to litigate (usually well into the five figures), the odds of prevailing, publicity that might result from the lawsuit, what size verdict you might recover (usually less than the cost of litigation) and the odds of collecting any money should you prevail.
