    My question involves criminal law for the state of: Philadelphia, PA.

    Last week I was on the subway around 9:30pm. When we got off I was holding an open can of four loko, and of course two cops stop me. They made me drop it, get up against the wall, then they proceeded to frisk me and check my information. Also, I am 21.

    I got a code violation notice. They told me they would not give me a citation for the alcohol, but it would be a lesser fine and I would have to pay $75. I was about to just pay it today, but I looked at what they checked off on the citation. They circled the $75, but not the check box, for PM 302.3 High Weeds. The "Other" box IS checked off and they wrote 10 604 next to it. 10-604 is for Alcoholic Beverages. They wrote exactly what happened in the comments.

    I do not know if this will go on my record as High Weeds, or for the 10-604 Alcoholic Beverages. Can anyone help? I do not want anything bad on my record for job purposes.

    It happened last Thursday, and it says I have 10 days to pay or plead not guilty. I do not know if those days count Memorial Day, but I need to do something ASAP. I do not want them to send something to my house for my parents to see.

    Ok...I'm confused. The cops stop you for open alcohol on the subway. But, they tell you that instead of citing you for that, they are going to cite you for not cutting back the weeds on your property??? How would the cops at the subway station have any idea what condition your lawn is in? Did they pass out BOLO notices with your picture and "wanted for serial failure to weed whack?"

    From what you have posted, you were cited for the alcohol. That is the charge that is going to court and, if you are convicted, will go on your record.

    Sorry it was confusing. The offenses listed on that citation are for high weeds, sidewalk not litter free, and trash set out early. I was confused because they circled the $75 next to the high weeds, but then also put the 10 604 in the other comments. I was assuming they were giving me the charge for high weeds just to make me pay for something that didn't look as bad, so I wouldn't get the actual alcohol charge on my record. They wrote it in the comments, so they could go back on it if I tried to fight the high weeds charge? I don't really know.

    Is the 10-604 violation something that I should really worry about, or should I just pay it and forget about it?
