    Repo of a Recreational Vehicle
My question involves an auto loan or repossession in the State of: Arizona or Washington?

Any help with this will be greatly appreciated....bought new RV in WA state 8 yrs ago w/Bank as lienholder on WA title ....moved and became resident of AZ in 2011...RV registered in WA state still but is located in AZ.

Since loss of jobs forced us into early retirement with Social Security as only income we have became unable to continue payments, or put gas in RV to use! We have attempted to sell it ourselves, bus since we owe more than the value, have been unsuccessful.

Notified bank of financial problems, and asked if they would possibly accept short sale offer....told of the minimum amount they would consider for a short sale & we have continued to list it for sale at their min. amount....still no sale.

Have got to the point of doing voluntary repossession BUT which states repossession law would apply--WA where sale originated & contract was initiated in---or AZ where the RV is located? There appears to be differences in the "Deficiency Requirements between the 2 states.

    Thanks for your help.

You seem to think the RV is residential property. It is a titled motor vehicle. Refer to your loan contract for terms regarding repossession.

Both Arizona and Washington will allow the creditor to pursue you for a deficiency following the repo and sale of a motor vehicle.
