Leaving USA While on Parole
My question involves criminal law for the state of: Nevada
I served 12 years on a 10 to life and on Parole. I have 8 years left on lifetime parole. I was born in Scotland and seek to retire there. I have dual citizenship. Is there any possibility of returning to my birthplace while on parole? What are the steps to proceed? (Scotland will not deny me legal entrance)
Re: Leaving USA While on Parole
Only 8 years to go. If you leave, I would not count on ever returning to the US for prison. I don't know if Scotland will extradite you or not.
Re: Leaving USA While on Parole
You'll have to get the permission of the sentencing court. It may be that your probation can be transferred, but you'll have to ask your PO.
Re: Leaving USA While on Parole
Do you intend to ever return to the United States? It's very possible that you would be able to leave this country and go to Scotland, but be prepared to face a host of serious legal repercussions should you ever want to return. The better strategy would be to ask your PO because it's ultimately going to be their decision and we could only guess without knowing the facts of your case.

My P.O. doesn't have a clue. he understands "Interstate Compact" but not other countries. Going back to court would benefit me as I have favor with that Judge. He is actually responsible for my release and would grant me any consideration. He is retiring this summer, so if this is true, I would need to move quickly. My only concern is maintaining my Social Security otherwise there would be other options.
Not necessarily. My kids and grand kids would love to vacation there, so that is not a criteria. Again, I don't want to lose my rertirement through deportation or something like that.
Re: Leaving USA While on Parole
Don't do the crime if you can't handle the time.
Re: Leaving USA While on Parole
If I am under the jurisdiction of the Parole Board, do you mean that the sentencing court must modify the sentence? or are you saying they have some other judicial authority? I appreciate your help!

You are correct, since it a parole matter, you will have to work with the parole authorities.

He's 100% correct. You are not eligible for any Compact relief. If you leave the country on a
10-life sentence, you are probably going to set yourself up for more problems than you realize. You can retire and spend it wherever you want. However, with this unfinished business that you are currently dealing with, you may not enjoy it.
Re: Leaving USA While on Parole
I want to do this legally or not at all. In Nevada I have the opportunity to appeal life parole after 10 years w/out any additional charges. It appears that this is the only option. I have talked w. Scottish authorities who have stated that If I left USA w/ approval, I would not have judicial obligations there. My original question was "Can I legally get approval to leave the U.S. while on Parole and it appears the answer is probably not. I have talked w/ 2 attorneys who do not know either. Surely this is not a unique case! Thank you all who have responded, I appreciate your candid response.
