    Tourist Visa Denied - Waiver of Ineligibity Recommended
    Hi, I was recently denied a tourist visa application to the US based on the fact i have minor motor convictions and a minor personal possession conviction for marjuana under section 212(a)(2)(A)(i)(II). Based on the fact these cases were old and minor the US consular recommended me for a waiver of ineligibility, withheld my passport and advised me the process would take 5 months to process and they would be in contact with me. I have since cancelled my trip to the US but my girlfriend (US citizen) continued on to the states. She and her family are very distressed that i am unable to attend a family wedding and have made contact with the US department of state and they informed me that no waiver of ineligibility has been processed. The local consular is not providing me much information and i have no visibility on where the process is at. Can this process be fast tracked? Should i be making the waiver of ineligibility myself, is there anything further my partner in the US can do?

    You were told that you needed to apply for a waiver. If you believe somebody else is going to file a waiver for you and pay the application fee on your behalf, you misunderstood what you were told.

    Your partner should get you an attorney to act on your behalf since neither of you appears to have any idea about immigration proceedings.

    Why should you expect any preferential treatment and have your application "fast tracked"? You have a DRUG conviction! You need to get in the back of a long line and WAIT YOUR TURN. You are asking for the privilege (you do not have a right) to enter the US. since you have already demonstrated that you have no regard for the laws in the country in which you were convicted; why should the US think you will engage in illegal behavior while you are in the US?

    If they want you to attend the wedding, the wedding needs to be postponed until it is determined IF you receive a favorable decision on the waiver (there is no guarantee that it will be) or moved to a country that everyone can legally enter.

    The US is only one of many countries that discourage the issuance of visas to convicted drug users.
