    First Degree Burglary Charges Against a Minor
    My question involves juvenile law in the State of: Maryland

    My son has just been charged with 1st degree burglary, Theft, and Destruction of property. He has 1 previous assault charge. Will he be sent to a Juvenile detention center?

    1si degree burglary usually involves violence or use of a weapon or causing injury to someone......if its some sort of domestic beef it's another thing but if he fits the first category the court will be reluctant to turn him loose - his age makes a big difference too......if he's 16 or older he could get sentenced....prior assault charge or CONVICTION ? If he pled to assault then its a conviction and won't help to keep him out of custody.

    he is 15 years old, no violence or weapons where used, and it was an abandoned house with no doors

    Cops often over charge juveniles assuming that it will get reduced in Juvenile court .....I don't know how what you describe amounts to Burg 1st degree - needless to say he shouldn't plead to anything but simple trespass unless there are other circumstances.......don't let any lawyer plead him to any form of felony burglary even if they say he can go home on probation......felony conviction even as a juvenile can follow you your whole life for job applications and military service etc.

    It just dawns on me that what you describe sounds like stealing copper from abandoned property.......simple larceny

    will the fact that the house is abandoned reduce the severity of the punishment?

    Someone owns the property...maybe the municipality city or whatever but its definitely not like entering a residence or a business......again no way should he plead to any form of Burglary........good luck
