    My question involves unemployment benefits for the state of: NY

    I was receiving UI which I discontinued after 4 months when I started a new job.
    I was let go from that job after 3 months. I'm still allowed to reopen my last claim
    but there is an online "Fire Questionnaire" that I need to feel out which made me
    worried. I was not fired but discharged/let go. Will I be qualified for re-opening UI?

    I'll appreciate your input.

    Fired/discharged/let go are all the same thing. It will depend on WHY you were let go that will determine whether your claim will be reopened. You have good reason to be worried because it does mean you might not get the remainder of your benefits.

    It wasn't for any misconduct or not obeying rules. It was because my
    experiences and qualifications didn't match with their needs.
    Will this be an acceptable reason to reopen UI?

    These are pretty flimsy excuses that smaller companies use to fight their case with ex-employees. Bigger companies don't follow this template. You would just get a layoff because big companies get sued, it's not worth their expense in fighting this, because their HR might be to blame.

    They could hold it against you in what you said during your initial interview or what you stated on your resume.

    I would reopen your UI claim and fight it and see why this small company is afraid to pay up now, or unable to admit their HR department screwed up by hiring the wrong person. HR departments mess up all the time because they don't understand the scope of what your job entails, and supervisors in departments don't spend the time to read resumes.

    I'm new to the forum and have a lot of experience dealing with big industry, and have heard all employment issues over the years.
