My wife filed I-485 for the adjustment of status and have received her temporary green card. After that she separated from me and now she is not returning. I want to be able to withdraw my I-864, affidavit of support. Is it too late to do that? She has already received a 2 year temp green card
If you wish to be not on the hook for support, you need an attorney to see if you can withdraw your original petition (not the I-864 itself). Given that the matter has already been adjudicated, this would not seem likely.
The Affidavit of Support cannot be withdrawn, until she loses any rights to be in the US that were created by the action.
