Contested Hearing and Discovery Request Timing Overlap
My question involves traffic court in the State of: WASHINGTON
I received a speeding ticket from a WSP officer on I-5 last Sunday in Pierce County. Should I request a contested hearing and file a discovery request in person on the same day to avoid a potential conflict between the minimum days that the hearing may be assigned in and the minimum time to file a discovery request prior to the contested hearing. If I do, what case number do I use on the discovery request template?

Yup. I always file the ticket ON the 15th day when possible. Generally you can wait a couple days then send your discovery, or you can do it all at the same time. Won't make much difference. Just make sure you ASK for the filing date of the notice of infraction from the clerk.

The Notice Of Infraction number at the top.
Re: Contested Hearing and Discovery Request Timing Overlap
Thanks for the response Speedy!
Does the 15 sequential calender days include the date of the alleged infraction, last Sunday April 29, or do I start counting with the next day, Monday April 30? If it starts on April 30 then I should go to the courthouse in Tacoma to request the hearing and file the discovery request on Monday, May 14.
Re: Contested Hearing and Discovery Request Timing Overlap
I would do it on Friday the 11th just to be safe. This way you have already gone past the maximum filing date for the officer (5 business days) and there is no possibility that you accidentally trigger the filing. Not sure if this really could ever happen, but better safe than sorry. You never know when a judge is going to have a bad hair day.
