Changing Status from J1 to F1 While Inside the U.S.
I am applying for a J-1 visa to work as a camp counsellor in June/July 2012. I have also already been accepted into a university in the US with a scholarship and intend on starting my studies late August. I have SEVIS numbers and all the necessary documentation for both visa's.
Will I be able to easily change my J-1 status to F-1 status while I am in the US? As my J-1 will only be valid for 2 months (without grace period), I will have to file my I-539 form with the USCIS quite early after my arrival in the US. Will my application for change of visa status be denied because I have "planned to change my status before entry to the US?"
(A reponse from Mr. Knowitall will behighly valued and appreciated! :) )
Re: Changing Status from J1 to F1 While Inside the U.S.
The time frame you describe is very short - even if you apply to change your status the day you enter the process may not be complete by the time your studies are scheduled to begin. Also, if your J1 is subject to the two year home residency rule you will have to leave the U.S. and reenter under the F1 visa.
I suggest starting with the college where you plan to study, as they may have an immigration adviser who can address the specifics of your case. An immigration lawyer could, of course, assist, but at a cost.
