What Are the Laws on Incest
My question involves criminal law for the state of: Arkansas
Hi this question is not about the age of consent or if it's ok for me to consent with someone. I already know I'm within the consent laws here. My question is what's the penalty for people under 16 committing incest consensual incest? I have googled under several searches all I find is under child abuse. But it's just I was wondering what the penalty was under my district? This is not a consent question. It's just a question on incest. He's my half-brother 15 and 14. He's 15 and I'm 14. It's a gay relationship. But I have a condition so idk how if this makes it the same. On a medical level I'm also female but legal assigned male gender along with we have never had homosexual sex so I mean that is the illegality itself right? So that can't be liable right? Um can a person face prison time for incest if between half brothers while both are under 16 and not under abuse?
ps this is common among estranged siblings as that is what we are.

this is not a question about abuse or age of consent it's a matter of what legal steps can be done about incest among two consenting 14 and 15 year olds. I just wanted to know what the law does in arkansas about incest among half brothers...
I know this is an odd question and that many don't come across it. But it's something I may face so it's why I'm questioning it now
Re: What Are the Laws on Incest
If you have not had sex, there is no legal issue. Lusting in your heart is only a worry if you plan to go on a talk show or something. Minors can not give consent. This is general comment. I do not know Arkansas law and could care less. Other people will likely give you more specific advice.
What is in your head regarding sexual identity makes no difference legally.
The law is not going to get involved unless you have bible thumping close relatives who want to make a stink about it or something. Maybe if the chief of police walks in on you doing it.
I don't see anything happening criminal. I see family services getting involved and all crap breaking loose if the wrong people find out. Minors are not in control of their lives. Don't go on any talk shows or put up any billboards, especially not in Arkansas.
I would suggest contacting some gay youth organizations, gay legal organizations and any support groups that deal with gay youth. You obviously know how to use the internet.
Don't keep a journal or keep any evidence. In any case, don't panic. When you get to be 18 you can write a book and do whatever you want.
Re: What Are the Laws on Incest
we have committed sex acts just not sodomy not every gay relationship causes sodomy to be caused... By committing sex acts I thought that was committing incest...
In this state I know consentwise I'm ok. As romeo and juliet laws are set. That's not an issue in this particular so yeah....
umm no it's actually on my medical papers I was born with an intersex condition. If it ever became a problem that could be brought up but it was more the fact incest being illegal that's why I thought there was a punishment or what? idk
also I do have support for my condition
Re: What Are the Laws on Incest
You need to stop creating multiple threads. The statute was posted and you were given 2 interpretations.
Re: What Are the Laws on Incest
You can access the internet and certainly research law on incest in your state. Is it incest for half brothers to have sex? I don't know.
Legally oral sex is sex. Any sexual contact is considered "sex".
Your condition is not material in the least from a legal aspect.
Before the law becomes involved, it has to be reported to the law and there has to be evidence. I don't see anything serious happening to two minors, but you need to research Arkansas law.
Hopefully someone else will have more knowledge on this area. I just don't have the time to research it, and you can do the same.
Re: What Are the Laws on Incest
this might make is clearer for you.
and it doesn't make any difference if it is homosexual or heterosexual in regards to this statute.
Quote:
5-26-202. Incest.
(a) A person commits incest if the person, being sixteen (16) years of age or older, purports to marry, has sexual intercourse with, or engages in deviate sexual activity with another person sixteen (16) years of age or older whom the actor knows to be:
(1) An ancestor or a descendant;
(2) A stepchild or adopted child;
(3) A brother or sister of the whole or half blood;
(4) An uncle, aunt, nephew, or niece; or
(5) A stepgrandchild or adopted grandchild.
(b) A relationship referred to in this section includes a blood relationship without regard to legitimacy.
(c) Incest is a Class C felony.
you should be more concerned about child endangerment laws or some form of statutory rape law such as :
Quote:
Sexual Misconduct - Section 5-14-107 (a) A person commits sexual misconduct if he engages in sexual intercourse or deviate sexual activity with another person not his spouse who is less than sixteen (16) years old.
I saw no Romeo and Juliet exception.
