    What's the Penalty for Incest With a Sibling
    My question involves criminal law for the state of: Arkansas

    I'm gay I guess you could say. My bf and I have been sexually active since I was 12. I could consent to anyone 4 years older than me. I think in Arkansas at least. He's within that age range. I like sex with him I want it to continue. I'm 14 now. I don't plan to end it. I don't want anything to tear us apart. I don't get why it matters what our relation is to each other. Love is love. It's not anyone's business but ours and we're ok with it. The thing is somehow my bf trusts too much. And his friend found out and threatening to out us at school. My parents will find out. And then the law will be involved I'm just curious am I likely to go to jail I mean for ongoing incest? For 2 years what do they do to first time offenders... If I have any information about unrelated crimes can I get off? And no I'm not going to put my under the bus and try to claim I was forced I actually have always felt that way about him. He's my half brother and his dad is hispanic. I'm white. He doesn't look related to me at all. So as you can tell I just want to know what's likely to happen to us?

    You are not currently criminally guilty of incest according to statute. Your brother meets one part of the statute, but as you are under 16, does not appear to be in violation yet. I suggest you both prepare to deal with the ramifications and take appropriate measures before you reach 16.

    or older, he purports to marry, has sexual intercourse with,
    or engages in deviate sexual activity with a person he knows
    to be:
    (1) An ancestor or a descendant; or

    (3) A brother or sister of the whole or half blood; or
    (4) An uncle, aunt, nephew, or niece; or
    (5) A stepgrandchild or adopted grandchild.

    Read the stickied threads, and tell him to call a lawyer.

    If your brother is sixteen or older he can be charged with incest, ARS 5-26-202.
