Retail Fraud or Shoplifting and Statue of Limitaions New York
My question involves criminal law for the state of: New York
A person buys something from a street vendor or other establishment and then exchanges the item in a department store w/o receipt. Gets the same product back not a refund. Is this retail fraud and/or shoplifting and if so what is the statue of limitations for charges. Items value less then 100$ and happened almost 18 months ago.

It sounds like theft by deception. Not sure of the statute of limitations.
