    No Contact Order Laws in Washington State
    My question involves no contact orders in the State of: Washington

    I am helping a friend do some legal research regarding a 'no contact order' Here is a brief history...

    In August of 2011 "Diane" and her then partner "Ann" had an altercation and the police were called. "Diane" admitted to slapping Ann and Diane was arrested. In November the judge didn't even get to see a letter Ann wrote saying she wanted all charges dropped. Ann didnt even show up to trial and the judge ordered a no contact order finalized. Shorly thereafter Ann contacted Diane through a mutual acquaintenance saying that she was moving to NY and wanted to know if Diane wanted any stuff. Ann promised not to put Diane in jail. Ann then contacted Diane directly and spent the last two days in town with her before moving to NY. Ann has moved back to Washington and continues to contact Diane and even says that she is coming back to town for the weekend next month. Diane is concerned for her safety and the safety of her family. However she is concerned that if she doesn't meet Ann then Ann will contact the authorities and inform them that Diane has been in contact with her and she will go back to jail. Diane is also worried to attempt to get legal advice because she feels this will be admitting that she was in contact with Ann. I explained to her that I felt everyone is entitled to legal advise regardless of the situation. She is hoping to get some answers before Ann's supposed visit next month.

    Also throw the following into the mix. Ann believed that another girl was coming to town to visit Diane and threathened her via text messages. "Telling ya your done" "and dont think im not gonna blow this in" "Tell cat (person's nickname) to cancel her ticket your done" "your done outta here" Does Diane have any recourse against Ann for making these threats ? Also what about the fact that these threats were done over a telephone and across state lines ?

    What are your thoughts on this ? How can Diane get confidential legal advice without fear of possibly being arrested ?

    Any help would be greatly appreciated ! :confused:

    Diane should not meet Ann. Diane cannot undo past violations of the no contact order, but she can control whether there are new, fresh, shiny violations for which the police could arrest her. While it is conceivable that she could be arrested for the past violations, it is much less likely than her arrest for "caught in the act" violations such as meeting the person whom the court has ordered no contact.

    Diane can speak with an attorney under attorney client privilege. Truthfully though, while legal advice might give her peace of mind, it would be expensive peace. If I were her, I would save my money and simply avoid Ann at all costs and in all manners, even if it means leaving town while she is in town. The cost of a nice weekend getaway might not be any more than an hour in an attorney's office and much more enjoyable. If she is arrested for a violation, that is when I would recommend seeking counsel.
