Can I Get Emancipated from CPS
My question involves juvenile law in the State of:Texas
I am 16, at the moment I live with my fiance' and we have been together for 2yrs and we've known each other almost 4 yrs. I was kicked out a month ago. I live with him until school is out or until they find an available home for me. My mother is deceased, and my biological father, unknown. I've been moved around, abused, anything you can think of, I'm through with being controlled and mistreated I want to be my own person. Is there anyway I can get emancipated???

Have you read the stickies on emancipation? None of the information you've provided is relevant. What IS relevant is how long have you been 100% self supporting - meaning how long have you been earning enough income to COMPLETELY support yourself - paying fair market rate for rent, utilities, transportation, health insurance, food, etc. If you're not currently doing those things (which you're not if you are at the mercy of others allowing you to live with them), then you are not a candidate for emancipation - regardless of any other circumstances.

You're a ward of the state?
No. In the state of Texas, you cannot be emancipated if you are a ward of the state, even if you were to meet all the other requirements.

You did a poor job of explaining your situation. Are you suggesting that your foster parents kicked you out? Did you run away from your placement?
If within the past month a judge confirmed that you are a child in need of services, unable to support yourself, there's no present basis to seek emancipation. Running away to shack up with your boyfriend doesn't help the situation - it makes you look like you're very much in need of supervision. You can ask your case worker if they have a program to transition you to an independent household in advance of your 18th birthday.
