    Can I Emancipate my Estranged Child in New York
    In the last year my oldest daughter has been estranged from me by her mother. I believe she is no longer living with her mother because she can never be found there. I have tried cert mail, multiple visits, the home phone call fowards to her mothers cell, and she is nowhere to be found. Can I file to emancipate her since I believe she is no longer under her mothers control? I would like to get support to her directly and bypass a mother who is of questionable morals.

    Your mere suspicion that she isn't with her mother isn't a basis for emancipation.

    Still Trying To Emancipate
    I am in NY and my daughter is 19 lives in her own apt, has a full time job etc. She even has a order of protection from her mother but the court is dragging its feet since Nov and it looks like it might be another several months before the court does anything. I filed a week after she got her apt. I have copies of her rent recipets, pay stubs, checking acct, drivers lisc, car reg and still the court is holding it off because her mother stated that officially she still lives at home since all of her things are there and some mail came there for her. She left her abusive mothers home with a garbage bag of clothes and never looked back. Her mother told the judge that she wanted her to move back home and because of that the judge put our date off until the middle of February. The reality is she cant afford to loose the child support. It has always been about the money. Sad. But I am the one who is on the short end of the stick. I will never get back this money(which if they grant emancipation in Feb will be over 7k) and this money could be better spent on my daughter and her new home and needs. Sorry for the rant but I can't even afford to talk to my lawyer anymore. Any advice would be helpfull. Thanks
