7 Months and No Charges for Aggravated Assault
My question involves criminal law for the state of: Utah
I was arrested nearly 7 months ago in Utah for felony aggravated assault. My bail was set at $50,000. After 72 hours in jail I had still not been charged and was released and given a piece of paper with a court date 14 days later. I showed up at the courthouse with my attorney, still no charges.
7 months later and still no charges. I just want to move on with my life already.
So my question is it typical to go this long without even being charged? Could this be an indication of something good or something bad as it relates to this case? Is there anything I can do to find out what's going on with this?
My attorney doesn't want to speak with the prosecutor because he says it will only draw attention to something that possibly slipped through the cracks.
Any input will be appreciated.

No, it's not typical. Yes, it could be "something good or something bad" - generally speaking a delay would suggest that the prosecutor has a problem with the case and/or key witnesses. Your lawyer may be able to finesse some information out of the prosecutor - but he's right that, if this has "slipped through the cracks" for some reason, reminding the prosecutor of the case can inspire the prosecutor to proceed.
