    Penalties for Drug Paraphernalia Charges
    My question involves criminal law for the state of: Indiana

    I was the passenger in my friends car. We both had an alcoholic drink or two and then headed to a gas station. My friend grazed a light pole with the back of his vehicle and it caught the attention of an officer who followed us to the gas station. When we got out, officer breathalized my friend. he passed but she claimed we both had dilated pupils and asked if we were high, or if there was marijuana on either of us or in friends car. I immediately admitted there was a grinder and glass pipe deep in my bag, in his car. She had to search and ask a few times where it was but eventually she found it. She confiscated it and gave me a ticket to go to city court for "possession of paraphernalia: a glass pipe and grinder". This is the first time.I've ever been in trouble.in my life with the law.

    Since that night I found out I'm PREGNANT. of course I've stopped smoking marijuana but I'm petrified of failing a drug test (i don't know if they issue them in court) because its been less than a month and I was a habitual user so I'm assuming I would still test positive. I'm also petrified about going to jail since I am very sick right now (awful morning.sickness) and I have awful anxiety. My last.bug concern is community service... Again, I feel very ill and wandering down the side of the road stabbing at trash with my baby growing inside me is.not something I think is appropriate.

    Can I request to just pay a huge fine? What should I do? Will I go to jail? I very much appreciate any insight.

    not all community service is collecting trash. I know of a person who had to work at a place like a Salvation Army or Goodwill store to serve their time. Lindsey Lohan served her time at the county morgue (I also know of another person that served their time at the county morgue).


    if they require a test, they already presume it will be positive but there are limits that you should not be above unless you used recently.

    do you have the actual statute number you are charged with?

    Erm... I realize that there are a variety of tasks I could perform. Can someone answer my question now?

    The ticket states an Indiana code number, a district number, and a county number but no other numbers.

    and the code number is what? That is the statute involved.

    If you already knew there are a variety of tasks that could be performed for community service, then why waste the bandwidth to complain on having to clean up roadside trash?

    you can request anything you want to from the judge. I would ask if he would let me off scott free in addition to paying me for any time I lost from work. I wouldn't get it but I can ask.

    Chances are since it's a 1st offense and a low level crime a fine will be issued or maybe even a diversion which can avoid a conviction,jail time is very unlikely. If for some reason community service is issued,they should be willing to work with you and I'm not totally sure but you probably volunteer at a nursing home for example or something not as grueling as pick up trash.

    Maybe also at soup kitchen for example. It never heard of someone being tested before going to court,maybe if you are given probation they will test you. It's really a minor offense,a lawyer can help arrange a better deal. I'm not a lawyer but I would think chance are they would just give you a fine. If you stay out trouble it's almost certain that you will not be given an jail time. It's a low level misdeamanor and 1st offense it's highly unlikely for them to put you in jail.

    The person asked a lot of your question and one of your concerns was picking up trash,if they didn't answer a small part of all the question,make use of what was provided. People do this for free. If you stop smoking weed a drug test shouldn't be a concern b.c they can tell it was from prior use.

    Community service can be done in a pleasant place,I highly doubt that they drug test you at any court appearance. Only if your given probation for some reason,I think you have a decent chance at just paying a fine and nothing else. When going to court having a lawyer is always good,talking to a local criminal defense lawyer should lessen your worry,some offer a free consolation. Try calling a few out of the phone book. They aren't gonna throw a peg-rant lady in jail for a pipe that was used to smoke some weed ,especially if that is your only offense.

    In Indiana, your first court appearance is called an initial hearing. At that hearing the maximum penalties for your charges are explained to you.

    Thanks to the people who provided small.bits of.info, especially Indy. As for the rest of.you, I forgot to omit sarcasm and a sense of humor because, well, you all blow at it. I simply got a ticket, and jk was just a smartass. Nothing they said was of value. Perfect material for a lawyer
