Trying to Move
My question involves a child custody case from the State of: Tennessee
My husband and I will be divorced in two weeks and within a month of our divorce I want to move. A little background, he left two years ago Feb 2010, and moved 7 hours away. He has decided three months ago he wanted visitation at that time I got him to do an agreed divorce. He has seen her 4 times in 3 months., so he is not consistant. I'm moving because I'm getting married and my fiance had to go ahead and move for work. I'm waiting on my divorce to be final so that fiance and I can marry. I am giving ex 60 day notice (TN law)... is there any else I need to do? Can I just move? I have told ex I would modify papers so that I have to cover half of plane ticket expenses His visitation states every other weekend visits but he doesn't use them. Is my only problem going to be if he decides he doesn't want me to move and hires and attorney? Should I consult an attorney before I move?

As long as your divorce agreement doesn't prevent you from moving out of state and you follow all state laws required by Tennessee you should be fine. I would consult your attorney just to make sure you've covered all your bases.

You will want the custody order that is issued at the end of your case to reflect that you are moving to another state, and to provide for a visitation schedule that will work given the distances involved (assuming your ex- decides to exercise visitation).
