Underage Possession of Alcohol, Age 18

I was in a car with some people, and they were drinking. I had a sip of a friends drink, to see what it tasted like. I had another sip of it a little while later to see if the taste was acquired. It was awful, so I stopped drinking it. Pretty much right after I had the second sip, the driver missed a turn signal or smt by accident (it was dark and we were lost).

Everyone in the car except for the driver and me were drunk. When the policeman asked if we had bottles in the car, we all said no, but when questioned individually I admitted to it. I got a breathalyzer test and my level I think was either 0.01 or 0.02. I willingly took it, after saying that I hadnt drank anything because I didnt think it would show up. I have pretty much 0 tolerance though (I never drink), and I'm really light, so I guess 2 sips did have an affect (they drank the whole bottle so it musta been pretty dilute too haha). They found 3 bottles in the car. None of them were mine of course.

Basically I overheard the officers talking and they said they either had to charge all of us or none of us. All of us were ticketed with a minor in possession of alcohol violation.

What should I do? I really cant have this kind of violation on my record because I have a lot on the line if I'm caught even in the presence of alcohol. I know I shouldnt even have gotten in the car with these people, but my friends car was full and I was the closest to these people so I was kind of pressured to go into the other car. I feel like especially compared to the other people in the car I didnt do very much wrong, though I know I made a mistake.

Should I get a lawyer? I have a court hearing in 2 weeks. What do I do? I'm planning on joining a very competitive program with the military, and I really cant afford this :(.

Get an attorney, they can most likely get you on probation and this won't stay on your record, it's a simple fine offense.

It couldn't hurt. A lawyer will know what state you're in, and whether you might be eligible for deferral or diversion in your county.

I'm sorry about that. I put NY in the title. Mybad! I'm from the state of NY.

And I'm planning on joining 2 very competitive programs, one with the government. I dont want to put that on the line.
