    Minor Shoplifting in Texas
    My question involves criminal law for the state of: Texas

    My minor daughter was caught shoplifting (less than $50) in Texas at JCPenny. Today, we received a civil claim from a lawyer claiming to represent JCPenny. The letter is a "demand that you pay $250 in satisfaction of this civil claim". This is in addition to the criminal claim.

    She has a court date for May. The summons state acceptable fine and costs are $550.

    My questions:
    1. Is this civil claim legitimate? Do I have to pay it?
    2. What will happen at the court date? Is there a way to make this not be on her record long-term so that it doesn't affect future jobs or colleges apps? Should I retain a lawyer? Will it do any good or just cost me more money?

    1. It's legit. Pay it or they can take you to Civil Court and the amount will be a LOT higher. If you still don't pay, it will be a mark on your credit rating.

    basically, the Civil Demand covers the costs incurred by shoplifters...those pretty cameras in the ceiling don't come for free. The people who watched your daughter shoplift and apprehended her - the store has to pay them wages, benefits....and a store manager likely had to take time away from his real job to deal with it also....

    2. A consult with a lawyer is always a good idea. Laws vary by state and even county, so a local lawyer will know what the court may do. Aside from court cost and fines, she may be ordered to attend an anti-shoplifting course (which you get to pay for).
