How Long to Discharged Debts Appear On Your Credit Report
My question involves bankruptcy in the state of: MA

Hello, my Chapter 7 bankruptcy was discharged in August, 2010. I've successfully had the credit bureaus update the records of my discharged credit card accounts to reflect that. My question is how long are these records supposed to remain on my credit report? Is it still 7 years from from the beginning of collection (or 180 days after the first adverse action that led to collection) or has the clock been reset with my bankruptcy filing so that these accounts will remain on my report 7 years from the date of the discharge?

Secondly, one of the items discharged in my filing was a personal checking account. I have continued to receive monthly statements for this account reflecting the negative balance since my discharge in 2010. Is this a violation of the FDCPA? There is no request for payment, just the regular monthly statement as if the account were still open.

    Thank you for the help,
    David

Re: Discharged Items on Credit Report / Monthly Statement from Discharged Checking Ac
Negative reporting accounts report for 7 yrs from the DOFD (date of first default). The date does not change due to a BK. So if you defaulted on CC 1 in Dec 2011 and you filed BK yesterday - the DOFD on CC 1 remains Dec 2011. Hth

Also BK's reporting SOL clock start on the filing date, not discharge date.

Absolutely. Thanks for reminding me of this.
