Possession of Drug Paraphernalia in Texas
My question involves criminal law for the state of: Texas
So recently, driving through Texas from California, our car was stopped by the border patrol and they found marijuana in the car. They were fortunate enough to just give one person a citation for Possession of Drug Paraphernalia. Im about to graduate college and I'm scared because I don't know what steps to take next. I know I will have to pay the fine of over $500 but is there any steps that I should take? I'm hoping that I can expunge this from my record and eventually seal it but I'm lost. And all the lawyers that I call in the Texas area all say the same thing, of how they'll call me back but they never do. If someone with a knowledgeable background can give me some advice, I would greatly appreciate it. First, Should I pay the ticket and then proceed to the other legal steps?? or What should I do? **And also if you can tell me if this would raise my drivers insurance, I would greatly appreciate it. Thank you so much as I am confused and this event has totally demoralized me.
Re: Possession of Drug Paraphernalia in Texas
I expect that you can find a Texas lawyer to represent you if you make a concerted effort. Ideally you will either get diversion, or get a deferred sentence for a Class C misdemeanor and (upon successfully completing the deferral) be eligible for expungement.
