Getting Unemployment After Being Fired for Not Calling In
My question involves labor and employment law for the state of: Illinois
I did not call for 3 days because I had to leave to South America to see my father who got a stroke. The day before a got a terrible fire with my husband. He was diagonalized with extreme anxiety and panic attacks. I was worry about this situation and I did not call. I applied for UI but they denied it. Now I am appealing and and do not know what I have to do with my situation. I also want to know If i did wrong to applied for UI or if I will have some adverse situation for applied UI later.
    Thank you

    Re: Termination
You were not wrong in applying for UI and previous UI applications are not considered in future applications. You will probably be denied again. There are two issues that work against you. First, not appearing nor calling for three days can reasonably assumed to indicate that you voluntarily resigned your position. Second, although failing to call once might not reach the continuous neglence threshold, failing to call three days in a row will.

    Re: Termination
Agreed. You did nothing wrong in applying for UC benefits. Don't expect the State to overturn their initial determination however. I'm sorry about your father's stroke but they have phones in South America too; you could have (and should have) called your employer.
