Divorce in New York if One Spouse Lives Overseas
My question involves a marriage in the state of:New York
My friend has lived in new york for 4 years. She came here and her spouse didn't come and has never set foot in USA. She is trying to get a divorce through New York state. She has filled out the forms, and is at the step to serve him papers, but he is in Philippines. How can this be done, and can this step be skipped? They have no children or property together. They were both Filipino citizens. She is on M-1 status in USA.

She can retain a process server in the Philippines to serve him. If she cannot do so for some reason, she can explore her alternatives with the court.
