    Recovering Lawyer Costs in a Support Modification Case
    My question involves a child custody case from the State of: California

    My son's mother is angry at me and I believe is going to attempt to modify our current court orders and get full custody of our son, totally barring me from his life. I believe she is going to try and base this on some comments my son was allegedly saying the day after he came back from visitation with me. She was somewhat unspecific but said he was saying "faster, faster" in a sexual manner and "I'm coming." She accused me of having sex in front of him. This is totally baseless and I'm shocked. Also it could have been us or her playing at the park and running with him or calling to a spouse about walking out the door that we are "coming." It could be anything really. I drive about 7 hours (or more) every weekend to get him and have barely ever missed a visitation except for a instances for work.

    At any rate I obviously feel this is unjust and do not think she has a case against me. However, I am really in the dark and I'm the father so I think the court will be biased against me anyway. I do not have a lot of money at all. I make very little after my current child support. If I do somehow find enough money to hire a lawyer, can I counter-sue to recover the money I paid to my lawyer? Is there any such thing as damages in a case like this? Am I just out of luck as usual? I'm tired of the fighting and just want to be in my sons life.

    Let's get some things clarified :)

    1. The courts are not going to care what gender you are - those days are long gone.

    2. Full custody won't bar you from your child's life.


    How old is your son? Have you remarried?
