    How to Get an Absent Parent to Sign over His Rights
    My question involves a child custody case from the State of: Florida and Colorado

    My daughter was born in Florida. Her father had a very small role in her life for the first year, seeing her only a couple hours a week and never providing for her financially. When I began seeing another man and he began seeing another woman he completely cut off contact with my daughter and myself. Recently my daughter and I moved to Colorado to be with my fiance. Her father never responded to emails, phone calls or text messages about me moving. I still keep in touch with his parents and sister but he has no desire to be a part of my daughter's life. My questions are:

    How long without out contact do we have to go before it is considered abandoment?
    Can I ask for him to sign over his parental rights?
    Will I need his permission for me fiance to adopt my daughter?
    Do we need to be married before my fiance can adopt my daughter?
    Do I need to file with a court in Florida or Colorado or both?

    You need to be married, stay married (to show the court stability) and then speak with an attorney if you wish to go ahead with a stepparent adoption.

    You can cite abandonment as a reason why Dad's rights should be terminated involuntarily if he doesn't agree to the adoption. However, if you file and he objects and then files for some sort of parenting agreement, the adoption likely won't happen at all.
