You don't have to have a history of having a cell phone in your name, you can simply buy a phone at 7-eleven if you want, comes with a prepaid card and deducts a certain number of "units" per minute for a call, and a certain number of units for each text message!
So the officer pulls you over, claims to have seen you texting while driving within -presumably the few minutes prior to the stop- and yet you knew that at the particular moment he saw you, "you were searching for tissue in your purse because last Friday you saw the doctor for an upper respiratory infecting excusing you from work"....???
In other words, he says: "I saw you texting and driving"... Your response "no, no... when you saw me, I was driving and looking in my purse for tissue" (if you were driving AND looking in your purse, you still had the time to look around and see what the officer was looking at the entire time you were "looking in your purse"...

I'd guess its a real citation where the fine is at approximately $159... A good chunk of money... Its not a silly thing. As for your chances, with ^THAT^ story? ZILCH!

If you even change the radio station, adjust the volume, you can get cited. Profitable.
