Simple Assault Charge - What to Expect at Hearing
My question involves criminal law for the state of: North Dakota

My brother was charged with simple assault after a bar fight that concluded with him breaking somebody's nose. His prior record includes an "actual physical control" charge 10 years ago and one speeding ticket. The hearing is scheduled for later this week and he is planning on pleading guilty as he does feel responsible for this incident. We have had no contact with a lawyer and he is not comfortable taking that step and would rather just show up to the hearing.

I would like to support him but I am not sure if just pleading guilty is the right way to handle the situation for the best possible outcome. As I said, he does want to take responsibility for his actions but I am trying to minimize the overall impact to his life.

He is terrified of receiving jail time as this will result in the loss of his job, etc.

Any advice would be greatly appreciated. It is unlikely that I will be able to persuade him to contact an attorney so either just some information on what to expect at the hearing or steps I could take would be wonderful.

    Thank you!

    A worried sister.
