Illegal Substance and Paraphernalia Put in Locker by Another Person
My question involves juvenile law in the State of: Ohio
I wanted to see if I could get some advise on a situation that happened to my daughter last week. A girl my daughter knows was freaking out in class about something and my daughter told her to just put it in her locker. Come to find out earlier in that day the other girl had a friend that was on probation was getting visited by his probation officer and he had brought marijuana and a pipe to school with him.
He had written a note to the other girl and said if he got locked up later that day to give the stuff to another student, which this note was taken by a teacher. The other student was called down to the office and she took the vice principal to my daughters locker and she got the stuff from her locker where she had put it.
My daughter was suspended from school for 10 days and being charged with possession of illegal substance and paraphernalia. She also has a pre-expulsion hearing scheduled for next week. The first thing I did was make an appointment with her pediatrician and requested that a drug test be done, which all tests came back negative.
Is there anything that can be done since there are written statements from the other kids involved as to what happened? It was not hers, another kid put it in and took it out of her locker (without her present)?

You need to get a lawyer who specializes in educational matters in your district.
Understand that NOTHING you have said mitigates the behavior of your daughter that is both contrary to school rules but could result in a criminal conviction.

was this locker both your daughters and the girl who surrendered it to the vice principal?

Jk took the words right out of my mouth. Your daughter may not have been present, but the other girl put the dope in her locker with your daughter’s knowledge and permission. I have to assume that the locker had a lock and your daughter provided the other girl the key/combo. So, basically, your daughter actively accepted possession of the dope.
I hope this goes without saying, but you and your daughter need to seriously reconsider the “friends” with whom she associates.
