When Can Child Support Be Changed to a Different State
My question involves child support in the State of: California. Husband is active duty, E5 paying 1200 in child support to his five year old daughter ON TOP of private school. The original calculation was based on BAH and BAS but he isn't receiving that anymore because we live in housing (still receiving bas but thats less than 350). He is about to be out 27MAR2012. He is expected to still pay for the 1200 and private school. is it possible to change the child support FROM california to virginia considering the child was born in va? btw california won't allow him visitation unless he moves to the west coast and i just got orders to the Truman so we're not going anywhere for a couple years....
PLEASE somebody give us hope!:(

If the child is now living in a different state than the one that issued the order, the parent may apply for enforcement through that state. If the payor is also in the new state, the payor can attempt to have jurisdiction transferred and to have support recalculated under the new state's formula.

Also keep in mind that even thou your husband is not receiving BAH in exchange for residing on base the court can use the fair market rental value of the onbase house in the calculation for child support so in reality this wouldn't make any difference in the child support calculation. BAS is for substancies i.e. food and your husband should still be receiving this regardless if living on base.
