Car Accident 100% Not at Fault, but No Insurance
My question involves an injury that occurred in the state of: Illinois
Okay so tonight my fiancée got into an accident, the other driver hit her from behind. My fiancé was turning right into the bank, had her signal on. The other driver must not have been paying attention cause she did not slow down at all, at the last second the driver tried to get in the left lane to avoid hitting her which clipped the left half of the rear bumper and made my fiancée spin into the banks parking lot and took down a sign. She hit her head during the spin. There were 3 witnesses who all told the officer it was the other party's fault. The lady admitted it as well. Now I'm trying to figure out the best way to go about this. The cars frame was twisted upward. It's and 03 Acura tl type s. I bought it last year and am still making payments on it, $6000 left. Should I get insurance right away, will it matter? Will their insurance cover the cost of the entire car? Any answers our greatly appreciated.

If you don't have insurance on the car at the time of the accident, buying it now isn't going to do you any good. Hopefully the other party is found to be 100% at fault, or else you risk the chance of fixing your car out of your own pocket.

and hopefully you are not upside down on your loan. You will get fair market value if the car is totaled. If you owe more than that, you will have to pay your lender that amount. A very quick look shows you are in decent shape as far as fmv and the amount you owe but there are a lot of variables that could affect that.

I think it's not her fault at all. It's totally third party's fault, so they must be pay to you as the compensation for your car and injury.
