My best friend was recently let go from a national chain department store in the Dallas, Texas area for employee theft. She is scared out of her mind and has no idea what to expect. Apparently she was interviewed by Loss Prevention and it was determined through estimation that she had caused a $520 loss to the store. The Loss Prevention told her they were going to continue to review video and a decision would be made about prosecution later down the line and they would contact her in the following weeks. She agreed to pay back the money the store had suffered as a loss and did so the next day after being terminated, as well as wrote apology letters to store management, district management, and regional management. She is 24 years old and does not have a single blemish on her record. She is looking to make things right for her moment of retardation and wants to get past this horrible event. She cant sleep and is having trouble eating worrying about this so I am looking for advice....
- Are most retailers content with full restitution payment or do they normally seek out additional prosecution?
- What should she expect as a charge if the company decides to prosecute?
- Should she seek out an attorney now, or wait until the company decides whether or not it is going to prosecute?
