    Thrown Out By a Roommate - Do I Have Recourse
    I was renting a room in Santa Barbara, CA from a "friend" of mine, there was nothing formal in place but she demanded her rent each month on the first. About 6 months back in fact I was traveling and she actually made me go to a local bank and deposit it in to her account. When I returned from my trip 2 or 3 weeks in to that month I had paid for, I went to bed where I proceeded to sleep for the next 24 hours. She told me I was using drugs (which I wasn't) and had a mutual friend ask me to leave one evening. She wouldn't even talk to me directly and just assumed I was using drugs, I really wasn't. There were no drugs I knew on with in 100 miles of that room. She gave me $120, my rent I had paid her was $700.00 and refused to pay more. I was forced to sleep in a hotel for the next few weeks while I got things together.. Only a few days after I moved out she took a ll of my stuff and moved it under her house, her son wound up in possession of one of my laptops which she recovered for me. A lot of stuff was never recovered. I just contacted her about a very expensive coffee machine I had which she apparently gave away. I was willing to sort of let this go but I found out she just pulled all of this same business on someone else.. She has just bought a new Porsche and I am struggling.
    What recourse do I have if any?? It's been less then a year and I would like to take some sort of action. At the very least I would like to get a months rent back from her.. What about for all the nights in the hotel room? The rent was $700 and that would help out right now plus she she shouldn't be allowed to keep doing this.. She is EVIL!

    It would have been much easier to help you if you had followed the instruction to tell us your state.

    Generally, as a tenant at will, you are entitled to 30 days written notice to pack it up and get out. You may be able to sue her for improper eviction.

    I am SO sorry... It is California... I thought of that after I posted.. I am just thinking a small claims court scenario here.. If I can get my $700 rent and X number of nights (at $100 per night) I stayed in a hotel...

    Read here.

    Depending on how much money you're out - factoring in the rent, hotel and meals, and the value of the property she disposed of - it may be worth your while to sue in Superior Court with the help of an attorney. One assumes you can prove that you were paying her rent and were receiving mail there? And you have proof that you owned the things you claim she disposed of?
