First Time Offense Drug Paraphernalia Charge in Maryland
My question involves criminal law for the state of: Maryland
Hello everyone, I recently was pulled over by the cops because of an illegal turn. The cops said they saw piece of weed in my car (I honestly did not have crumbs of weed in my car, I eat a lot of food in my car and it can look a little dirty in there) and decided to search my car. This is my first time ever getting pulled over so I didn't fight it and let them search my car. The cop asked me if I had any weed in my car, and I said no I don't, however I have a pipe in the car. This is my first ever offense, my history is clean, and I did not have any weed in the pipe. However, they found an empty baggie in the car, so I'm afraid they could use that against me in court. I was very polite with the officers and they said I wouldn't have any big penalty for it, but I do have to go to court. What kind of penalty do you think I would get, if anything, and what are some of the things I should say (or not say) in court to help my case. This is my first time in court as well. Help me out guys!

What exactly do you mean by "I didn't fight it and let them search my car"? Do you mean they said, "That looks like marijuana there, can we search your car?" and you replied, "Yes," the question of whether they were mistaken is mooted by your consent.
