Charged With Drug Possession, Larceny, Violating Probation,

My question involves criminal law for the state of: MASSACHUSETTES

My last case lasted a year and a 1/2 my charges were posession of class B, Class C, and distribution of Class D
+ larceny under $250
The Verdict was : 1 year probation + drug testing, my case was solved 3 weeks ago.
In the meantime i was put on probation, i was met with my probation office this wendesday she referred and sent me to a different probation officer in a closer town.

THE STORY ***

We were working a late job which involved blinking flashing lights, my girl is an eptilimetic sp?* and has seizures, it was 2 a.m and she has a seizure, a VERY serious one, it lasts 5 minutes, foaming from the mouth, not breathing I thought she was going to die, and she hit her head on the cement. The EMT comes and drive her to the hospital.

At the hosptial we are there for ~3 hours, and they take her blood do a scan on her head and everything is fine, you can tell by talking to her she wasn't normal.
anyway while leaving the hospital a 20 feet walk to the door and exit, she has a seizure and falls. its on camera, they do NOTHING, put her on the bench for 10 seconds while I get my car for pickup.

anyway I can tell shes not right next morning she wakes up she has another seizure and breaks her front two teeth, shes a very pretty girl, and she starts crying hysterically, and has SEIZURE AFTER SEIZURE. I drive her to a hospital in town walk her in they can;t take her because its more of a rehab they say drive her to a different one, im pissed get in car drive her there, i get pulled over by police car, they say previous hospital told us about you and you want EMT i say sure, on the car seat is 2 mood stabilizier pills on my seat. They say whos are those, I say mine. they say do you have a script i say yes, its a (CLASS E SUBSTANCE) they walk to cop car i say they are actually her dads ( they weren't). they take her away in the EMT, and arrest and charge me with posession of class e and larceny from building.

I said the pills were mine, and that I took 2 earlier, and they were her fathers. Is it possible to say that they were actually hers and I didnt want to get her in more trouble or put her under more stress, and that she needed the mood stabiliziers to calm her down. I did not sign a statement, she is willing to sign the paper say that they were indeed hers adn that I was taking the blame.

ALSO, you think if we sue the hospital the first one, we would have a chance of winning since after the seizure they saw and when she fell they just let her go.

so, whose were they? To argue they were anybody in particular, you will need to provide a prescription. Whose prescription was it?

You are grasping at straws that aren't there. You need a lawyer to save yourself from yourself.

You are grasping at straws that aren't there. You need a lawyer to save yourself from yourself.

I said they were mine trying to get out of trouble for not having the bottle on me, they weren't mine, and they weren't her fathers, they were someone elses?

the father lives in delaware, they were given to us by a friend. If she writes a statement to the Court saying it was her would that work.

if she cannot provide a prescription for the meds, her writing something will mean nothing, unless of course you mean she is willing to accept the criminal charges of possession of drugs illegally. Are you suggesting she take the fall for your drug possession?

yes take the fall ^, im on probation with lots over my head she has nothing, wats maximum offense for posession Class E.

if she accepts the blame, you are still guilty of obstruction of justice for lying about the drugs. That would mean that you could still catch Hell for the lie and she could be penalized for possessing the illegal drugs.

and with a very quick look, it appears she could face up to 6 months in jail and/or up to a $500 fine. Sorry but allowing your GF to face possible jail time (although most likely would not happen) is the sign of something I would not consider a man, as in manning up and facing your penalties for your actions.

if you lie to stop an officer from doing his duties, then you are guilty of "obstructing justice"......a "class A misdemeanor

and you lied to stop an officer from doing his duties which was to investigate a crime of possession of a class e drug without a prescription.

the situation I wasn't thinking straight, Couldn't make a rash deCision, the girl in the Car was having seizures on the spot and I was frantiC, worrid my gf I didnt want to get her in trouble. I was also in the same mind set as her, she lost her teeth having seizures I was witnessing this and also worrid for her.

that's all well and good but the fact remains; it was your drugs and asking your gf to risk jail (and she would almost assuredly end up with some sort of criminal record even if she didn't end up with jail time, which could have a considerable impact on future events) is a weenie thing to do. Sorry guy but I see this as your problem and you need to deal with your actions.

Maybe this is a good time to swear off illegal activities.

by attempting to change the situation, you risk causing a lot more problems for everybody and quite possibly not gaining anything. Speak with a lawyer is about the best suggestion I have.
