Violation of Deferred Judgement in Juvenile Court
My question involves juvenile law in the State of: Colorado
I was recently placed on a deferred judgement program for Greenwood Village, CO. I was caught with possession of tobacco by a minor. My conditions of deferred judgement were no conflict/citations with a police officer for 1 year, complete 24 hours of community service, and complete a court ordered class. I have completed the community service and class, however I'm still on deferred judgement until July of 2012. Recently I was caught in possession of tobacco, possession of marijuana (under an ounce), possession of drug paraphernelia, and violation of a tobacco/drug free zone. My question is what is going to happen? I know I made a mistake by getting caught once again, I am currently enrolled in a substance abuse program required by the school, if I show proof of that to the judge will that make a difference? Also I was suspended for 3 days.
Re: Violation of Deferred Judgement in Juvenile Court
Juvenile court judges have broad discretion to impose sentences that they believe to be in the best interest of a minor. If you want to know what the judge is likely to do in your case, your best bet is to consult a lawyer who is familiar with the judge's practices. It's pretty clear at this point that you're not voluntarily complying with probation, so the judge may deem it necessary to impose more monitoring and drug testing or more serious consequences.
