    Caught Stealing, First Offense, Don't Know What to Do
    My question involves criminal law for the state of: Texas
    A friend of mine (not a friend anymore) told me to steal items adding up to 27 dollars, and me being as stupid as i am did it. i started to walk out of the store but before i actually left the store employees stopped me and brought me to there room where they took down info and pictured me. Police show up a little bit later and arrested me, but my rights were not read at all. I was jailed for about 20 minutes till i was bailed out and when i was the jailer said that i did not have to show up for court unless i wanted to fight it, which i don't. she handed me my receipt and tells me that its all over. i get home where my parents tell me that i need to get a attorney and try to remove it from my record.
    My question is, since i never left the store is this theft? The police not reading my rights mean anything? Do i still need to show up for court? Im really scared right now and i dont know what to do, any info will be appreciated. Im 18.

    Since i never left the store is this theft? - Yes it is. They don't have to let you exit the store.

    The police not reading my rights mean anything? - No, it doesn't. Unless, they asked you questions that would led to self - incrimination or an admission of guilt.

    Do i still need to show up for court? - Do not take the word of the "jailer" - talk with an attorney.

    You will also be receiving a Civil Demand letter in the mail from the store/it's lawyers. Expect that to be atleast $150. And this does need to be paid or it can lead to Civil Court, more money, and screw your credit history right from the start.

    ok thanks and what is the normal punishment for this, as this being my first and only offense? what do i expect in the times coming from this?

    In court, you can expect court costs and fines; and any costs associated with any first time offenders program, ACD, etc. If you get Community Service, you also get to pay for that.

    Additionally, you can expect difficulty finding work, especially in the retail field.

    Don't just plead guilty see what can done to lessen the damage,follow your parents advice and get a lawyer. Maye it can get dismissed some how or they will offer a diversion program like pandora said. It's probably just a fine but having a record is the bigger issue. If the finally result is a class c misdemeanor with adjuaction witheld then the charge can be expunged in the future. Also ask about any pre trail diversion programs.

    Ok so my dad had a judge friend that got me a lawyer and it seems as if we are going to talk to the prosecuter about a deal combining community service and forfeiture of the bond, while this settles the case and removes the misdemeanor off of my record. This judge said that he has helped young people fix there stupid mistakes before so im hoping for the best right now... i have a week till i meeting up with my lawyer so now im wondering what the process with a lawyer will be. Now how comin is it that deals like these work out? I will keep yall updated with what happens from here on out when i can. Thanks alot

    i dont know about that, because i just came from the lawyer and he is going to push hard with this and try to make said deal. i will post what happens as it happens
