Second Offense MIP
My question involves criminal law for the state of: California.
So I got a misdemeanor MIP two years ago and got it brought down to an infraction, didnt loose my license, and just did community service and paid about $100. Now stupid me got caught again and I'm 20. Now I want to know is this a 2nd offense or is it my first one because I got the other one reduced? Should I hire a lawyer again? Also will the court know about the last one and is it possible to just end up like the first one? Im going to a christian college in august to be a engineer will that help my situation greatly? I could care less about the ticket/fine I just still want to be able to drive and go to school there....

This is still your second offense. A lawyer is not a bad idea. Yes, the court will know about the last one. It is possible it will end up like the first one, but don’t count on it. No, court will not care what college you are planning to attend or what your major is.

Went to court today and the ticket has not been filed yet. Is this somewhat of a good thing or are they just being lazy about my ticket? Is there a chance it'll never get filed and dismissed? and is that usually a year after?

I like how nobody replies but for future people looking at this situation, the ticket got filed and i have court in a month so ill post back what happens after

Nobody replied because any answer from anyone other than the court itself would be nothing more than a WAG (wild a$$ guess).

I read somewhere that the judge can't drop the license suspension. Just got my first MIP (infraction) with a clean record and I'm worried that I'm gonna get my license suspended. Will this citation stay on my record? I heard you can pay for some program and the suspension will be dropped and nothing will go on your record.

get a lawyer i got out of my license suspension for the first one and thats all im trying to do with this second one

Went this morning for my second MIP Misdemeanor, got it reduced from a 500 dollar fine to 75 with no community service and it turned into an infraction with a license suspension for a year, but I get to drive on a restricted license to and from school and work. I would highly suggest the help of a lawyer it helped me keep at least a restricted license and I don't have to say I've ever had a misdemeanor on any apps.

The weird thing is, you know your license is suspended. If the system shows that your license is suspended and you are caught driving, you'll be arrested for DWLS. It's called strict liability. You are guilty even without an official letter stripping you of your driving privilege. You've already been informed.
Just because I care...Instead of bankning a lawyer's pockets, why don't we suggest no drinking until you are old enough?

yeah but i keep calling into the dmv and they say I have a valid license so idk and come one really, the only reason why drinking is illegal for people between 18-21 is so the government can get more revenue. It has nothing to do with the person plus with less than a month away its stupid to say anything like that. They used to give babies in holland wine to take a nap and also parents used to dip there fingers in hard alcohol for the babies to suck on. USA is one of few countrys in the world whose drinking age is 21. Have you ever read ayn rand's atlas shrugged, one makes so many laws that it becomes impossible to live without breaking at least one of them. I dont want to hear any stupid comments/opinions im just letting everybody know my personal situation because i was pissed that every story i read never told the final situation.
