Changing a Minor's Last Name After Disestablishing Paternity
My question involves name change laws in the State of: Florida
My problem is the following:
I got married at 15, separated at 17, while separated i gave birth, since i was still legally married, she carries my ex husbands last name, he took custody of my child, and the way i got her back was by doing a dna test. Came out to be he was not the father, so i got custody back, i had put her biological father on childsupport, been 8 yrs and still havent received anything. He has left this country and theres no way of me contacting him. I have court papers , stating that my ex husband does have no legal right to my daughter. Till this day she still have my ex husbands last name, and was wondering how can i give her mine? im in desperate need of answers, any advice will help ..... by me having court papers that the judge is stating that my ex husband does not have legal right, do i still have to go through court to have his last name removed?

Contact a local attorney to see about how you would change your daughter's last name. Is your Ex-Husband named as the father on the birth certificate? Or is the bio-dad? That may have some bearing on how you need to go about it.

My ex husband is in the birth Certificate,, Child support contacted me, saying that whenever i go to court with the bio dad , that they would give me a new birth certificate, thats problem it has been months since they stated that to me. Theres no way to contact the biological father.
