Identity Theft and Fraud
My question involves criminal law for the state of: Virginia
On Saturday a cop showed up at my house and said he was investigating a case of fraud and identity theft and that I am apparently their main suspect. The person the fraud was commitd against used to work with my disabled child in my home in 2007. What happened is someone got a payday loan in her name, ssi number, address, etc but used my internet. On Monday the cop called me back to inform me that the deposit from the payday loan place was sent to her bank account but a few days after the deposit was made she withdrw all the money and closed the banking account, apparently she told the bank at that time someone had commited fraud against her. I have been housebound medically for several years now, I know I was housebound at the time she worked here also. I did not do this to her and I have never been in trouble and I have no idea what I need to do. Any advice is greatly appreciated.

Who else could have been using your internet service at that time?
And please confirm - she alleged that she did NOT take out a payday loan, but upon receipt of the funds in her account she WITHDREW the money and then closed the account?
Has she returned the money to the loan company?

As far as I know just me and her, my son was too small at the time to get on a computer, she stayed on my internet a lot while she was here. Yes she told the cops she didnt take out a payday loan, the amount was $200 and yes she withdrew the money from the payday loan at the time she closed the account. The loan company has not been paid back and im still not clear on who has brought these charges up, her or the loan company

She took the money and closed the account....that's suspicious. I'm sorry, but I'm just not seeing how YOU can be charged with this. It doesn't make any sense - if you had taken out the loan in her name, would you not have had it deposited into YOUR bank account?

Thank you for answering me, I really appreciate it! The cop wont tell me anything, all he said was he was waiting on more information, some about me but he wouldnt tell me what it was. Ive been a nervous wreck over this. I know right? I wouldnt put the money into her account if I were going to do something like this, I would use either my account or get a prepaid card or something.

I can't promise or guarantee anything obviously, but it sounds like she took out the payday loan herself, doesn't want to repay it and is now trying to blame whoever she can.
I wouldn't worry too much at this point. If you do get charged, please come back (and speak to an attorney of course).
