What to Do About a False Battery Charge
My question involves criminal law for the state of: Illinois
Last month I was charged for intoxication, and battery. I was out with Co workers, having drinks and everything was fine. We were there for awhile, enough time for a shift change between bartenders. Long story short, the second bartender told us to leave. she threatened to call the police, and I walked outside behind her. She ordered me to sit down because she was calling the police. I said we were leaving, but she started calling me names and cursing at me. I started yelling back, and she started swinging towards me. I blocked with one arm, stepped back and tripped, when i threw my other arm out. I "slapped" her in the face.on accident. I even said that I didn't mean to do that and sat down myself. Before I knew it, two guys grabbed me and flung me around before the police arrived. I was charged with intoxication as nd battery. She had no marks, and just went back to work. Its my first offense. Im nervous, and cant have this on my record or i could lose my job. Can anyone gice me advice? Or what i can expect if i chose guilty or not guilty???

Sorry, that is not a false charge of battery. You can find an attorney and fight this case, but in no way, shape, form of fashion, is that a false charge. Tell me what town you're from, and I might be able to give you an idea of what kind of punishment you are looking at. But, you got witnesses and a slap. You are going to have an uphill battle on this one.

I should have been more clear, there were no witnesses outside when this took place. Just her and I. The two males came outside once she started screaming that she had been slapped. And false charge was probably the wrong way to phrase it. I didnt mean to slap her face the way she accused. I was trying to keep from falling and keep her from hitting me in the face. Like i said im new to this stuff. She is accusing me of outright hitting her on purpose, and she didn't even mention her part in the argument. I know that it should be taken seriously when a male hits a girl, but this wasn't intentionally done. Even the police officers were understanding to a point when I Was able to tell them how it happened. I don't mind the fines or probation or community service because I did act like an idiot, but.... I don't want this to ruin my job or future employment.

Ask for supervision if it's on the table. It's a temporary admission of guilt in IL. Two years after the final court date, you'll be eligible for expungement and it'll be completely erased from every database. Your honestyis a welcome change of pace and it will go a long way in terms of completing any probation quickly and satisfactorily. Good luck.
