Teenager Charged With Second Degree Battery
My question involves juvenile law in the State of: Maryland
I made my account because back on December 13, 2011 i had went up to another student after verbal exchange, and i tried to swipe his book bag from his locker and throw it on the ground but failed... after that he PUSHED me first, which led me to swing at him 3 times, only making contact once, after being pulled away from another student... there is a video of the fight on my iPhone that we showed the Principal, School Cop, and Vice Principle.. and they suspended me for THREE days, and charged with assault 2nd Degree/Battery..... while on the other hand, the other student gets NO CHARGES or no suspension days... we got a letter in the mail from the Department of Juvenile Services and we go to see an Intake Officer February 2, 2012... what could possibly happen? or do you think will happen? thank you

I think that you will be suspended for 3 days and be convicted in juvenile court for 2nd degree battery. YOU were the aggressor in the incident. Whatever "verbal exchange" took place prior does not justify your actions. The other student's push was a wholly reasonable response to your aggressive action to take his/her property by force. Therefore, the push does absolutely nothing to justify you punching him/her. Considering that you tried to take property, and used force to do so, you could have been charged with felony robbery. I do not believe such a charge would be appropriate for the scenario you describe, but it DOES meet the statutory requirements.
Cowboy up and take your medicine...and talk to you parents about getting you some anger management counseling.
