How Do I Get Pretrial Diversion
My question involves criminal law for the state of: Georgia, Lawrenceville
Im about to go to court for a charge of shoplifting items worth around $180. my court date is on Feb 1. This will be my first offence and i decided to take this semester of school off due to the stress i been undergoing. Besides that, my question revolves around a pre-trial diversion. When am i able to get it? how do i get it? do i ask the judge at my first trail?
by the way in georgia its a misdemeanor

You ask your lawyer. Or if you can't afford one, you plead not guilty and ask for a public defender.

Would you perform your own appendectomy? Likely not. You need a professional to guide you through the system.

You need to determine (a) if pretrial diversion is available in the court in which you're being prosecuted and, if so (b) whether you qualify. Pretrial diversion is not available everywhere. There's also deferred sentencing - but once again you will need to find out when deferrals are offered in your county and if you qualify. There may be information on the court or prosecutor's website; your best bet, though, is to consult a local criminal defense lawyer.
