    Meth cant really be the only exception can it?. Her dad has a criminal record, and I think they might be giving the baby sleeping aids or something to get her to pass out while my ex-goes out with her friends. I need help here.

    No, meth was just an example to demonstrate the EXTREME nature of what it takes before a court removes a child from the primary care giver.

    Unless dad's crimes were violent crimes at the level where he spent years in prison, or unless his crimes include convictions for sex crimes against a child, it's not relevant.

    When you can PROVE that the baby is being drugged, THEN the court will take that into consideration. Court is all about PROOF.

    What you NEED is an attorney.

    Her income is irrelevant - as long as the child has food, clothing, shelter, etc., the court doesn't care about the mechanics of how they are provided. The court also isn't worried about mom and baby staying with her dad - after all, dad apparently successfully raised his own daughter into an adult, and having an extra pair of hands around is generally GOOD for the child.

    The bottom line is that since you weren't married to mom, you will now have to work through the court to establish rights and responsibilities that a marriage certificate would have given you automatically. That process takes time, and during that time, mom and baby will be bonding and mom will be acting as the primary care giver. The court will take it as a priority to KEEP the primary caregiver in that role until and unless she is found unfit.
