My question involves a child custody case from the State of: florida
my daughters father and i had an issue with a family member of his. he currently lives with this family member and he wants to keep our daughter overnight. i dont trust him to give her back to me like he says. i dont want our daughter to be around this family member due to how violent and unpredictable they are. he wont understand and constantly threatens me because i dont want our daughter there, this has gone on for 6 months now. i dont know what my rights are and what his rights are. we arent married. his name is on the birth certificate. he has seen her and visited with her with me present. he is demanding that he spends his time with her on his own. im not comfortable with that.

Without a court order in place you don't have to allow any visitation.
Be aware that once Dad does get a court order, he will be allowed to have her unsupervised, without you present, and eventually for longer periods including overnights, weekends and entire weeks in the summer.
He'll also be allowed to take her around his family members even if you don't like them unless you can prove that the family member is a threat.

i have a police report of domestic violence and a restraining order also. but would a court order insure he would have to give her back to me or not? he is also requesting that his name be taken off the birth certificate.

A restraining order against whom? Does it include the child?
A court order cannot promise that your child will be returned - but it DOES make it somewhat easier to retrieve the child and have the right people on your side.
He can request what he wants - but unless you have a husband willing to adopt the child, it's not going to happen.
