Child Support and Physical Custody Modification
My question involves child custody in the State of Washington
Hi. I am the stepmom of a 16-yr old child. My husband's ex-wife has sole physical custody of the child but they have joint legal custody. Now, the child is coming to live with us because he wants to live with his dad and he is witnessing domestic abuse with his mom's new husband. The divorce was filed in Las Vegas although the ex-wife and kids live in California. I think she just pretended to live there for a while and filed the divorce because it was easier to get it there. She has given consent for the child to live with us. My question is where will we file for modification of child custody and child support? Is it in Las Vegas who issued the divorce and child support decree or in California where they have been residing for years or can it be filed in Washington state where we are right now? Thanks...

the court that issued the order has jurisdiction until somebody seeks to have jurisdiction transferred to another state. Then, if Nevada relinquishes jurisdiction and the court being petitioned accepts jurisdiction, you deal with whichever court you transferred jurisdiction to.
and just for a point of clarity:
WE do not do anything. Your husband is alone on this as far as the court actions go.

thanks for the reply... yeah... i made the mistake of saying we.... anyway, is there anybody here who can help me with paper works to fill up? How can my husband transfer the jurisdiction to California? I checked Nevada and it says that you cannot file for modification if the child has not been a resident there for the past six months.... We cannot afford a lawyer so we'd like to do it ourselves, if possible. Thanks!
